What is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy is also known as a “reorganization” or “repayment plan” bankruptcy. Unlike Chapter 7 bankruptcy, which liquidates the debtor’s assets to pay creditors, Chapter 13 bankruptcy restructures the debtor’s debts and allows the debtor to pay off the creditors with future income within a 5-year period. Chapter 13 is appealing for those individuals who have regular income and have non-exempt property that they wish to keep.
